GAP Insurance Through Dealership URGENT!

* Background- I am rebuilding my credit from a bankruptcy that was discharged 4/2015, all the money I had for a trade in and my vehicle were used for the purchase* I purchased a vehicle 5/22/15. The initial contract was not honored but we were able to come to a mutual agreement and I kept the car. I decided against the warranty and kept the GAP through the bank. I verified this was covered and was told yes, if it was not I would have purchased through my car insurance. I was hit by a semi on 9/4/15 on the freeway. The car has finally been totaled 17 days later. I was going to do a substitution of collateral and now the dealership says that I do not have GAP through them, although the bank has a copy of this signed contract. Can the dealership be held to GAP? I do have an attorney but do have a lot of angst. Thank you in advice!
