Could he go to jail? Pls answer.

Okay so In October or November my dad was taking me and my brother to school. It was a normal morning like always. We were coming up to a stop sign waiting for the other cars to go. It was out turn to go we made our stop and my dad pressed the gas and a kid ran in front of out car and we hit him. It wasn't really hard. He didn't hit our windshield or anything but he fell on the floor and idk why but he ran off after that. My dad didn't see him at all before he ran In front of us. My dad didn't go after him because he didn't want to scare him I guess. Obviously my dad called a patrol officer and told him what has happened. Now my dads asked to go to court. Could he go to jail? Or could we get sued?
