Constitutional law questions.

What constitutional issues does war in general pose for criminal law?
How has the “War on Terror” affected society from a criminal law, criminal procedure, ethical and social standpoint? Any detail response for both question would be greatly appreciated :-D

General: Whether non-citizen enemy combatants are treated under the same rules as US citizens. Generally it's the argument that's taken place over the Guantanamo Bay imprisonment. Do they have a right to a speedy trial for example.

Terrorism: How much of our rights to privacy can the government take to protect us from terrorists? If they keep lists of who we talk to by phone, is that the same as wiretapping? Do they need a warrant just for a list of the telephone numbers we communicate with?
