Are anime streaming sites like KissAnime legal?

Here's the thing. For years, I've been watching anime on a site called KissAnime, which streams current and very old anime for free. It also gives users the chance to download these same videos without charge. Recently, however, I've learned that this site and others like it may be, in the legal sense, pirating their material. But after looking up the Fair use policy of the Copyright laws, as well as their claims for complying to these laws, I can't find any proof that they are in-fact pirating their videos. Still, I'm concerned. Could someone who understands law please set me straight?

Here is the thing about piracy. You cant be charged for watching illegally obscured content online, the only ones who can be charged for it are the people who run the site
