Can I sue my old phone provider for breach of data protection?

My old phone provider had my faulty phone for repair I could switch it on, but was told I was going to be provided with a new phone as it was beyond repair. A year on a man contacts me on Facebook saying he had been given my old phone as a loan phone, the phone contained my contacts, my email address, emails, messages and worsly 1700 photos and videos of me and my son. The photos contained my pregnancy photos, labour room, under wear photos from after birth.
The man new my sons name and date of birth.
Can I sue for breach of data protection?
