Can my dad come and get me with no trouble?

So my mom took me out of state to move to another state. She made me stop talking to my dad up until last year. I want to move with my dad but my mom will not let me. My ddad says she can go to jail because she took me out of state without his permission but I don't want her to go to jail I just want to live with my dad. So if my dad comes to this state to get me will they call it kidnapping towards him or running away towards me?
