Spitting on someone, how long in jail?

Ok, basically I was out one morning and a man in a car decided to become quite aggressive towards me in his tone of voice and expressions, when I confronted him he swore at me etc about where I was deciding to park, I walked away, he began to shout abuse, I walked back and after more shouting I spat at him (yes I know this was terrible of me to do) I am a Paranoid schizophrenic with paperwork to back this and I rarely leave the house, when I did, this happened. Anyhow, I am due at magistrates soon and wondered what the implications of this may be? I do have a criminal record, not of violence but other crimes I have already been to jail for....

will they send me to jail straight from the magistrates court? or will they just caution me etc

there was no witnesses at the time this went on, I just need some kind of idea.

thanks in advance

It is virtually impossible to predict what a judge might do. If he/she is in a good mood, it could be different than if they had an argument with their spouse before they left home that morning. :-)

If you have any witnesses, make sure they come to court. If you explain the situation to the magistrate like you have above, I think your chances are good. Be ready to explain why you chose to turn around and come back. That answer will be critical to your case.

In addition to what Rob said, I'd recommend getting an attorney.
