I don't know what last name to give my baby !? please help!

Ok...I live in Virginia. I am due to have a baby in October. I need an answer to all of these questions. I AM SO CONFUSED...

1. Can I give my baby the fathers last name if we are not married?

2. Can I give my baby the fathers last name if he is not present to sign the paternity papers?

3. How can I have the father sign paternity papers if he is in jail? Is it possible via mail or something??

4. If I am 16 & the father is 18, will there be any complications when I put his last name on the birth certificate?

5. I just need to know mainly, can I put the fathers last name on the birth certificate if he is not present...without it being an issue????

Call a Virginia Office of Vital Records customer service representatives by dialing 804-662-6200. They are open normal daytime hours during the week.

The age of consent in Virginia is 18. "Consensual sex where one partner is 15, 16 or 17 and the other is over 18 is a class 1 misdemeanor." There could potentially be trouble depending on whether of not he was 18 when you conceived. If he was 18, speak to an attorney first since it's possible he could be charged with a class 1 misdemeanor.
