Self-defense. You are a police detective investigating a homicide case in which the defendant shot and killed a man who had broken into her apartment and threatened to rape her. He was eight inches taller and 60 pounds heavier than she was, and she stated that she feared for her life.

a) In such a case, is lethal force justified for self-defense? Why or why not?

b) What other factors would you consider in a case such as this?

Again, laws aren't the same everywhere. In most jurisdictions, you are obligated to use any avenue to escape before you shoot. If such avenue is not available and you fear for your life or the life of someone else, you can shoot them.

Some states have a "Stand your ground" law that doesn't require that you make every attempt to flee. In a state with that law, she would not be charged. In a state without it, it would depend on the facts. Most officials would be very sympathetic to her situation if she had no motive to harm the intruder.
