Crazy landlord suing for bogus damages. Scared and helpless here.

I moved from Vermont to Alabama and rented a trailer over the phone from a man without even seeing it. It is $500.00 a month plus a pet deposit of $400.00 and no lease. I wired him $2900.00 which is pet deposit plus 5 months of rent in advance. I moved in phyiscally on November 19th, 2011 and moved out on March 9th, 2012. I was certain that he owed us $500 for moving out early and had paid in advance and we also paid for propane a couple days before moving out and the propane company said because he rented the tank that he needed to give us our propane back. When I told him all of this he was fine at first. Then he ignored me for a few weeks and I told him maybe we should take this to court. Well he started being nasty to us and harrassing me. I dropped wanting my $500.00 because it started to become not worth it. He is now emailimg me saying we DAMAGED his property! I cry every day. This is 100% NOT true. We didn't damage anything. First he said we owed him 2500.00 and now he sent me an email this morning saying we owed him 5,850.00! It was a dumpy trailer to begin with and we didnt damage anything. I have a video that I took after we emptied the place. Of the floors, walls, cracks, crevices, doors, ceilings, lights, fans, appliances, sinks, toilets, closets, tubs,mirrors, counters! It is a video walk thru that shows NO damages. I also have witnesses and emails from him being nice in the beginning saying he would give us our money and quote (take care of us).This man is insane! We never even met him once for the 90 days we lived there. Please help me. What can I do? These damages are bogus and all lies. I have never dealt with anything like this in my life. We are being victimized and I am scared.

Try to breathe. You have evidence and a paper trail.

If I were in your situation, I'd talk to an attorney. You can check with your local Bar Association to see what your options are for free or low cost legal advice. Also, check with any tenants' rights organizations and/or your county housing office to find out what your rights are. Any of those organizations/offices should be able to help you identify more resources to combat this.

I really am scared. It's sad but I am pretty sheltered. I have never been in trouble in my life. Never even smoked tried drugs or ever been in confrontation with someone regarding court! Know nothing about it. This man is plum crazy! The thing is, I have no money to afford a lawyer. All I am hoping is that with my video evidence (which clearly shows no damages) and all my emails and witnesses that the judge will see the truth of what is going on. :-(

I mean we only lived there for 90 days for crying out loud! We worked, and slept and that is it. We aren't the type of people who damage things. We are good, decent, quiet people. Anything that we were not at work, we were with my grandparents because my grandmother was dying. Thats the reason we sold our hosue in VT and moved to AL. To be with our family and that trailer was the closest available rental at the time we moved. The week after she died, we moved out and into a nice little house and that is when this all began :-(

I had to take a crazy person to court once, and I just had a death in my family. I couldn't imagine having to deal with both at the same time. Definitely find out what city, county, and state resources are available to you for free so you can understand your rights and be your own best advocate. The Legal Shield thing is somewhere between $17-30/month. I'm not remembering clearly off the top of my head. You can call them as many times as you want and get all the advice you need to take him on confidently in court. And don't forget you can countersue for emotional distress and legal/court costs. Also check to see if binding arbitration might be an option to keep this out of court. Most judges don't want to be bothered with cases as "small" as this. Plus arbitration might be less stressful for you.
Thank you for your advice. I am going to look into all the resources you have suggested. I hope it all works out because this man is crazy. I can't imagine someone full of such lies and deceit getting away with this. I mean the law is still the law and what he is doing is wrong. I hope someday he gets what is coming to him for all the times he has tried to victimize an innocent family. Thank you

If you have the video and a date along with it to prove that there weren't any damages then you are probably alright. It sounds like if this does make it to court you have ample evidence against him. But make sure that you bring every paper and scrap of evidence that you can find on it. Definately try to get a good lawyer if you can.

Thank you for your support. Thing is, I work part time for a bank and make very little money. Can't afford a lawyer. I do have my video evidence that clearly shows NO damages and I have witness's and affidavits but I don't know anything about court. What if thats not good enough and he gets away with this? :-(

Don't say "what if". Focus on what you have, because what you have should win a court battle.
