Is it legal to kill someone that tried to brake into your house, that threatened to kill you?

Just wondering.

Ask_Sean Says, In my opinion no, but its the law to not to murder or kill so I think you'l get charged (my opinion is if they threaten you, you've got every right to kill em!)

In most states, to use lethal force, you are required to take every avenue of escape available. You can't go home, get your weapon, come back then claim self defense.

You must be in immediate fear for your own or the life of another. The issue wouldn't rest on his breaking in or what he said. If he points or comes at you with a lethal weapon, that would be the green light .

Well I know if you live in tennessee you legally can shoot someone if they break into your house. However, you can not kill them, unless they actually point a gun at you or come at you with a knife.

All such cases come down to the specifics of what happened. I once did a criminal defense investigation for an idiot who stabbed an unarmed guy 19 times then claimed "self defense." You can imagine how that went over. The truth doesn't always set you free. :-)

Good to see your flag. I hope school is going well.

yeah its good to be back. schools going pretty good. its really difficult but that's probably because I go to one of the top schools in the nation.
if say you shoot them from the front of their body, you could easily get off for self-defense. From the back, it might take longer to prove that they were still a danger to you hence you shot cause their attorney could prove that they were running away...
or some shit like that
