A husband and wife are almost divorced and legally seperated for almost 3 years. Who gets the kids?

The kids are not their own biologically however the 2 girls are the husband's neices. They have been caring for them for 4 years but now that the two are divorcing their grandmother would like to have them. The wife just recently had a stroke and is the hospital and the kids are in between neighbors' houses. The wife is 50 years old and the children are 5 and 3. She has some health issues. She also drinks,smokes 3 packs of ciggarettes a day, and pops pills all day. She does not work nor has she attempted to get a job. Child services has been to her house 4 times but nothing seems to happen. How can grandma get these kids?

Time for grandma to get invoived, That means talking with child services and a lawyer.
