I was involved in a attack, should I sue?

About 3 weeks ago I was hit in the head with a glass bottle repeatedly by another kid, about the same age as me, 20. I was trying to stop a fight that was going on with a friend of mine, I did not throw any punches kicks or anything. The kid hit me in the right side of my head about 8 times with a glass bottle, causing me to bleed profusely. I had 2 wounds in my head and had to be taken to the emergency room. I received 10 staples and 5 stitches, I have photos of my bloody face and the wounds from the hospital. The NY police found the suspect, who also did this same thing to another kid that night, and the suspect is now facing felony charges. Me and the other victim that night both confirmed his name and confirmed that it was him when we saw him at the police station. I was issued a subpoena to appear in court for the felony case which is the state of new york vs the suspect.
My question is: Would it be worthwhile to sue with a lawyer? Can I get money out of this case? etc..

yes, you can. You can sue for all your hospital bills and pain and suffering. If he attacked you first and he started it (even if you did throw a few punches) you can sue him. You don't even need a lawyer-you can sue him in small claims court, but if your medical bills are more then what your state allows for small claims, then you might want to seek an lawyer. And you can even sue for future treatment if you need any.

Like niteowl24 said, you can sue. You are a victim of assault, which is a crime. You would almost definitely win the case, it's definitely worth it. He owes you for personal damages.
