I need help with Deed issues.

My parents deeded to me my grandparents house. i got married & my wife & I took out a loan to fix the house up. Both of our names are on the Deed of Trust. We are now divorced and still owe five years on the loan.She remarried & moved out & I have taken over the payments, but she will not sign off on the loan. The house is empty . Can I lawfully move back into it or rent it out as my name is the ONLY name on the Warranty Deed. What is she entitled to? Thank you for your time

You need to consult an attorney. <- The proper answer.

But if it was me and I was making the payments, I'd tell her if she doesn't sign a Quit Claim Deed on the property (get a fingerprint on the document), I'd stop the payments and mess up her and new hubby's credit. Tell him, too. Then I'd stick the unmade payments in savings and tell the loan company I was temporarily out of work and how much money the two of them were making. I'd sweat her until she signed (and catch up the payments as a backup plan if things got desperate). This requires chutzpah and discipline, but my bet is you move in pretty quick once you get the Deed signed. <- The real world answer.
