If the same hospital performed both surgery's you can send them a copy of both bills they sent you and inform them, before the 2 year anniversary date, that it was their work that failed and that if they won't accept the responsibility for the repair of their faulty work you will be forced to seek an attorney and immediatley file a suit against them for the General and Special Damages their negligence has caused you.

Then place a deadline for a response and sign it,

Sincerely,

Your Name

Of course, you could just file against them anyway.

I may even know an Atty in your area. They love personal injury or medical negligence claims and it won't cost you a dime unless the screw coming out was your fault and the hospital can prove it.. If they could prove it, I would be very surprised.

Your only other option is to take it and pay the bill, over time after you recover, if you ever do so, or you can file for bankruptcy but you have to pay for that in cash before they will file for you.

Good Luck!

I went thru a similar situation after I broke my neck in 3/08. My repair failed because I got an infection that softened my spinal bones.

Over all, I spent a year and a half recovering from my injury, and of course I'll never be able to twist or bend my neck properly again, but I can live with that...
